Abstrak

Makalah ini menyajikan analisis yuridis terhadap UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, dengan fokus pada keselarasannya dengan mandat konstitusional Indonesia untuk menjamin hak atas lingkungan hidup yang sehat. Penelitian ini menggunakan metodologi kualitatif, dengan menggunakan penelitian hukum doktrinal untuk menilai koherensi, efektivitas, dan implikasi dari undang-undang tersebut dalam kerangka prinsip-prinsip konstitusional. Temuan menunjukkan bahwa meskipun undang-undang tersebut memberikan kerangka hukum yang komprehensif, beberapa inkonsistensi dan tantangan implementasi menghambat efektivitasnya. Isu-isu utama termasuk ambiguitas dalam definisi hukum, kapasitas kelembagaan yang terbatas, dan mekanisme penegakan hukum yang tidak memadai. Makalah ini diakhiri dengan merekomendasikan reformasi hukum, peningkatan kapasitas, dan peningkatan partisipasi publik untuk memperkuat tata kelola lingkungan di Indonesia dan menyelaraskan kerangka hukum dengan mandat konstitusional.
