Abstrak

Penelitian ini mengkaji peran penting Mahkamah Konstitusi dalam membentuk demokrasi Indonesia melalui analisis yuridis terhadap mekanisme pengujian undang-undang yang diatur dalam UU No. 24 Tahun 2003. Mahkamah Konstitusi berfungsi sebagai pengawal Konstitusi, memastikan bahwa tindakan legislatif selaras dengan prinsip-prinsip konstitusional. Penelitian ini menggunakan analisis yuridis dan normatif untuk mengevaluasi efektivitas dan dampak dari proses pengujian undang-undang terhadap tata kelola pemerintahan yang demokratis di Indonesia. Temuan penelitian ini menyoroti pengaruh MK dalam melindungi hak-hak konstitusional, menyelesaikan sengketa konstitusional, dan berkontribusi pada pengembangan norma-norma demokrasi. Selain itu, penelitian ini juga mengeksplorasi tantangan dan keterbatasan yang dihadapi oleh MK dalam menjalankan fungsinya, dengan menekankan perlunya kerangka hukum yang kuat untuk meningkatkan perannya dalam memupuk demokrasi. Analisis ini menggarisbawahi pentingnya Mahkamah Konstitusi dalam menjaga keseimbangan kekuasaan dan mendorong supremasi hukum dalam lanskap demokrasi yang terus berkembang di Indonesia.
