Abstrak

Penelitian ini mengeksplorasi implikasi yuridis dan normatif dari UU No. 11/2008 tentang Informasi dan Transaksi Elektronik (UU ITE) terhadap UUD 1945, khususnya berfokus pada keseimbangan antara kebebasan berekspresi dan keamanan siber. UU ITE, yang diberlakukan untuk mengatur transaksi elektronik dan penyebaran informasi, telah menjadi bahan perdebatan mengenai kesesuaiannya dengan hak-hak konstitusional. Penelitian ini menggunakan analisis yuridis dan normatif untuk menilai bagaimana UU ITE sejalan dengan prinsip-prinsip yang diabadikan dalam UUD 1945, memeriksa ketentuan-ketentuannya dalam konteks menjaga kebebasan berekspresi sambil memastikan keamanan siber. Dengan mengevaluasi pasal-pasal kunci dan interpretasi hukum, studi ini menyoroti potensi konflik dan sinergi antara jaminan konstitusional dan regulasi siber. Temuan-temuan tersebut menggarisbawahi perlunya penyempurnaan legislatif untuk menyelaraskan kepentingan-kepentingan ini, dan menyarankan amandemen yang meningkatkan kepastian hukum dan melindungi hak-hak individu tanpa mengorbankan keamanan nasional. Analisis ini berkontribusi pada wacana yang sedang berlangsung tentang peran hukum dalam mengelola teknologi komunikasi dan informasi digital di Indonesia.
